Para compor a mesa, foram convidados o registrador de im\u00f3veis de S\u00e3o Louren\u00e7o do Sul (RS), J\u00e9verson Lu\u00eds Botega, a ju\u00edza auxiliar da Corregedoria Geral da Justi\u00e7a do Estado de Mato Grosso (CGJ-MT), Edleuza Zorgetti Monteiro da Silva, e o corregedor-geral da Justi\u00e7a do Mato Grosso, o desembargador Luiz Ferreira da Silva.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Entre os t\u00f3picos abordados pelo registrador de im\u00f3veis, destacaram-se a qualifica\u00e7\u00e3o registral, instrumentos particulares, escrituras p\u00fablicas e decis\u00f5es do Conselho Superior da Magistratura referente aos atos administrativos.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cQuando se fala de qualifica\u00e7\u00e3o registral, a primeira dificuldade \u00e9 que a ess\u00eancia da atividade do registrador imobili\u00e1rio est\u00e1 diretamente relacionada \u00e0 pr\u00f3pria qualifica\u00e7\u00e3o registral. A segunda dificuldade decorre porque o pr\u00f3prio texto legal n\u00e3o \u00e9 preciso ao estabelecer os balizadores da realiza\u00e7\u00e3o da qualifica\u00e7\u00e3o\u201d, iniciou Botega.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Antes de adentrar mais profundamente no assunto, Botega estabeleceu as bases relativas \u00e0 atividade, pois s\u00e3o necess\u00e1rias para que o assunto qualifica\u00e7\u00e3o de atos e t\u00edtulos administrativos possa ser enfrentado. Em sua explana\u00e7\u00e3o, o registrador fez uma abordagem r\u00e1pida da legisla\u00e7\u00e3o, citando o artigo 198 da Lei n\u00ba 6.015, e tamb\u00e9m os decretos anteriores, como o 4.875 de 1939 e o decreto 1.000 de 1969.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cAnteriormente t\u00ednhamos um balizador de validade e legalidade. A Lei n\u00ba 6.015 n\u00e3o possui essa informa\u00e7\u00e3o. Diz que precisamos fazer a an\u00e1lise dos t\u00edtulos identificando se h\u00e1 algum problema a ser apontado\u201d, explicou. De acordo com o registrador ga\u00facho, inexistindo dispositivo legal sobre a qualifica\u00e7\u00e3o registral, cabe aos registradores extra\u00edrem das normas que orientam a atividade os balizadores da atribui\u00e7\u00e3o.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201c\u00c9 de consenso e n\u00e3o se discute que o registrador ao realizar a qualifica\u00e7\u00e3o possui autonomia. Autonomia essa que nos d\u00e1 liberdade, independ\u00eancia no exerc\u00edcio da atividade da qualifica\u00e7\u00e3o, mas esse ju\u00edzo qualificat\u00f3rio deve ser orientado pelas fun\u00e7\u00f5es pr\u00f3prias da atividade\u201d, explanou.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Segundo Botega, s\u00e3o quatro pontos que podem orientar a qualifica\u00e7\u00e3o registral, sendo eles: a natureza jur\u00eddica da atividade; a finalidade substantiva da atividade; a natureza jur\u00eddica do ato praticado; e os efeitos do registro, seja ele constitutivo ou declarativo.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cAl\u00e9m disso, um item muito relevante nessa an\u00e1lise, diz respeito a natureza formal do t\u00edtulo apresentado para registro. Parece \u00f3bvio isso, escritura p\u00fablica, instrumento particular, t\u00edtulo judicial, t\u00edtulo administrativo, mas precisamos antes de iniciar a qualifica\u00e7\u00e3o, extrair dos t\u00edtulos as caracter\u00edsticas que s\u00e3o pr\u00f3prias deles\u201d, ressaltou o registrador, que tamb\u00e9m falou dos atributos no momento da qualifica\u00e7\u00e3o, destacando a presun\u00e7\u00e3o de legitimidade.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cO ato administrativo tem presun\u00e7\u00e3o de legitimidade. E o que isso quer dizer? Presun\u00e7\u00e3o de validade, legitimidade e veracidade. Segundo essas caracter\u00edsticas, uma vez praticado o ato administrativo, ter\u00e1 ao seu favor a presun\u00e7\u00e3o de que foi praticado de acordo com a ordem jur\u00eddica. O que isso quer dizer? Que ele \u00e9 v\u00e1lido, que \u00e9 leg\u00edtimo, e que o seu conte\u00fado \u00e9 verdadeiro\u201d, acrescentou.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O registrador prop\u00f4s um conceito de qualifica\u00e7\u00e3o, que em suas palavras serve para todos os t\u00edtulos. \u201cO controle da legalidade dos t\u00edtulos apresentados para registro \u00e9 efetivado mediante a qualifica\u00e7\u00e3o registral. Esta qualifica\u00e7\u00e3o decorre do princ\u00edpio da legalidade. Trata-se a qualifica\u00e7\u00e3o registral de um poder\/dever conferido ao registrador imobili\u00e1rio pela lei. O registrador n\u00e3o tem a faculdade de qualificar, tem o dever de qualificar. Ao realizar o ju\u00edzo qualificat\u00f3rio, o registrador analisa, com a finalidade de depurar, extrair as imperfei\u00e7\u00f5es de forma imparcial e independente, os aspectos extr\u00ednsecos e intr\u00ednsecos do t\u00edtulo. Respeitados os limites das atribui\u00e7\u00f5es e da natureza formal do t\u00edtulo\u201d, relatou Botega.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A debatedora Edleuza Zorgetti Monteiro da Silva fez um breve discurso afirmando a essencialidade da atividade do registrador de im\u00f3veis. \u201cFiz um estudo e vejo como a qualifica\u00e7\u00e3o do ato \u00e9 essencial \u00e0 atividade do registrador. Quando ele verifica e analisa os pressupostos de exist\u00eancia, validade e efic\u00e1cia dos neg\u00f3cios jur\u00eddicos e dos requisitos do t\u00edtulo, est\u00e1 atribuindo certeza e seguran\u00e7a jur\u00eddica. Acredito que todos os registradores, querem registrar, mas v\u00e3o primeiro fazer essa qualifica\u00e7\u00e3o do ato\u201d, declarou a ju\u00edza auxiliar.<\/p>\n<p>&nbsp;<\/p>\n<p
