A proposta, em an\u00e1lise na C\u00e2mara dos Deputados, altera a <a href=\"https:\/\/www2.camara.leg.br\/legin\/fed\/lei\/1990\/lei-8009-29-marco-1990-366074-norma-pl.html\">Lei 8.009\/90<\/a>.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A lei estabelece que o im\u00f3vel residencial familiar n\u00e3o responde por d\u00edvidas contra\u00eddas pelos propriet\u00e1rios, sendo assim impenhor\u00e1vel.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O deputado Jonas Donizette (PSB-SP) disse que o projeto de sua autoria n\u00e3o muda essa regra, mas permite que o credor da d\u00edvida do propriet\u00e1rio da casa insira essa informa\u00e7\u00e3o no registro p\u00fablico do im\u00f3vel, o que pode atrapalhar a tentativa de vend\u00ea-lo sem quitar as d\u00edvidas preexistentes.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cO objetivo n\u00e3o \u00e9 impedir a venda do im\u00f3vel impenhor\u00e1vel, mas sim de informar a terceiros de boa-f\u00e9 sobre a pretens\u00e3o do credor, especialmente na hip\u00f3tese de afastamento futuro da prote\u00e7\u00e3o contra penhora\u201d, disse Donizette.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A proposta est\u00e1 baseada em julgamento da 4\u00aa Turma do Superior Tribunal de Justi\u00e7a (STJ), ocorrido em 2021. O tribunal decidiu que a prote\u00e7\u00e3o do credor e de terceiros justifica o registro de protesto contra aliena\u00e7\u00e3o de bem de fam\u00edlia.<\/p>\n<p style=\"text-align: justify;\"><strong>Pr\u00f3ximos passos<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O projeto ser\u00e1 analisado em car\u00e1ter conclusivo pela Comiss\u00e3o de Constitui\u00e7\u00e3o e Justi\u00e7a e de Cidadania (CCJ).
