class=\"entry-content\">\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Altera as Resolu\u00e7\u00f5es CNJ n. 81\/2009 e 203\/2015.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A PRESIDENTE DO CONSELHO NACIONAL DE JUSTI\u00c7A (CNJ), no uso de suas atribui\u00e7\u00f5es legais e regimentais,<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0CONSIDERANDO o disposto na Lei n. 12.990\/2014;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0CONSIDERANDO o disposto no Estatuto da Igualdade Racial (Lei n. 12.288\/2010);<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0CONSIDERANDO o que foi decidido pelo Supremo Tribunal Federal na ADC n. 41, que considerou leg\u00edtima a utiliza\u00e7\u00e3o de crit\u00e9rios subsidi\u00e1rios de heteroidentifica\u00e7\u00e3o \u00e0 autodeclara\u00e7\u00e3o de pessoa negra, bem como na ADPF n. 186, que entendeu constitucionais as a\u00e7\u00f5es afirmativas para promover a igualdade racial;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0CONSIDERANDO o relat\u00f3rio da Pesquisa sobre Negros e Negras no Poder Judici\u00e1rio, realizada por este Conselho Nacional de Justi\u00e7a e divulgada em 2021;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0CONSIDERANDO a import\u00e2ncia da atua\u00e7\u00e3o da Comiss\u00e3o de Heteroidentifica\u00e7\u00e3o nos concursos p\u00fablicos do Poder Judici\u00e1rio, a fim de evitar fraudes e a utiliza\u00e7\u00e3o indevida da cota racial;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0CONSIDERANDO o deliberado pelo Plen\u00e1rio do CNJ no procedimento de Ato Normativo n. 0005298-94.2023.2.00.0000, na 12\u00aa Sess\u00e3o Ordin\u00e1ria, realizada em 22 de agosto de 2023;<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE:<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Art. 1\u00ba O art. 3\u00ba da Resolu\u00e7\u00e3o CNJ n. 81\/2009passa a vigorar com as seguintes altera\u00e7\u00f5es:<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cArt. 3\u00ba \u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 style=\"text-align: justify;\">\u00a0 \u00a0 \u00a01\u00ba-A \u00c9 vedado o estabelecimento de nota de corte ou qualquer esp\u00e9cie de cl\u00e1usula de barreira para os candidatos negros na prova objetiva seletiva.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026\u2026.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a06\u00ba As comiss\u00f5es de que trata o par\u00e1grafo anterior dever\u00e3o funcionar preferencialmente no ato da inscri\u00e7\u00e3o ou antes da publica\u00e7\u00e3o do resultado final do concurso, de acordo com os crit\u00e9rios de conveni\u00eancia e oportunidade de cada tribunal.\u201d(NR)<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Art. 2\u00ba O \u00a73\u00bado art. 2\u00ba da Resolu\u00e7\u00e3o CNJ n. 203\/2015passa a vigorar com a seguinte reda\u00e7\u00e3o:<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cArt. 2\u00ba style=\"text-align: justify;\">\u00a0 \u00a0 style=\"text-align: justify;\">\u00a0 \u00a0 \u00a03\u00ba \u00c9 vedado o estabelecimento de qualquer esp\u00e9cie de cl\u00e1usula de barreira para os candidatos negros, bastando o alcance de nota 20% inferior \u00e0 nota m\u00ednima estabelecida para aprova\u00e7\u00e3o dos candidatos da ampla concorr\u00eancia, ou nota 6,0 para os concursos da magistratura, para que os candidatos cotistas
