{"id":35584,"date":"2023-07-07T15:18:22","date_gmt":"2023-07-07T19:18:22","guid":{"rendered":"https:\/\/www.anoregmt.org.br\/novo\/?p=35584"},"modified":"2023-07-07T15:18:59","modified_gmt":"2023-07-07T19:18:59","slug":"oficio-circular-no-345-2023-dfe-cgj-interpretacao-do-artigo-9o-da-lei-6-015-73","status":"publish","type":"post","link":"https:\/\/www.anoregmt.org.br\/novo\/oficio-circular-no-345-2023-dfe-cgj-interpretacao-do-artigo-9o-da-lei-6-015-73\/","title":{"rendered":"Of\u00edcio Circular n\u00ba 345\/2023-DFE\/CGJ &#8211; Interpreta\u00e7\u00e3o do artigo 9\u00ba da Lei 6.015\/73"},"content":{"rendered":"<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A Associa\u00e7\u00e3o dos Not\u00e1rios e Registradores do Estado de Mato Grosso (Anoreg-MT) informa que recebeu da Corregedoria-Geral da Justi\u00e7a o Of\u00edcio Circular n\u00ba 345\/2023-DFE\/CGJ, que trata esclarece a d\u00favida sobre a interpreta\u00e7\u00e3o do artigo 9\u00ba da Lei n. 6.015\/73 (que imp\u00f5e a anula\u00e7\u00e3o do ato registral praticado fora do hor\u00e1rio regular de funcionamento ou nos dias em que n\u00e3o houver expediente), notadamente \u00e0 luz da relativiza\u00e7\u00e3o proposta no Enunciado n. 20, aprovado na I Jornada de Direito Notarial e Registral de 2022 (que limita a anula\u00e7\u00e3o somente ao servi\u00e7o de protocolo de t\u00edtulos e sua respectiva lavratura).<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Os esclarecimentos feitos pela Corregedoria aos registradores de im\u00f3veis do Estado Mato Grosso s\u00e3o:<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;a) o protocolo de atendimento (balc\u00e3o) iniciado dentro do hor\u00e1rio de funcionamento regular da serventia poder\u00e1 ser conclu\u00eddo no mesmo dia, depois do hor\u00e1rio-limite, ainda que importe na lavratura e\/ou registro de atos (leia-se, selagem ou lan\u00e7amento em livros). Com efeito, quando tais protocolos n\u00e3o puderem ser conclu\u00eddos no mesmo dia, dever\u00e3o aguardar conclus\u00e3o no expediente \u00fatil subsequente;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>b) Os servi\u00e7os internos que n\u00e3o exigirem selagem ou lan\u00e7amento em livros poder\u00e3o ser praticados em qualquer dia e hor\u00e1rio;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>c) a lavratura e\/ou registro de atos do foro imobili\u00e1rio extrajudicial em dias e horas n\u00e3o-\u00fateis demanda pr\u00e9via e expressa autoriza\u00e7\u00e3o do Juiz Corregedor
