Neles, a propriedade do bem \u00e9 transferida para a institui\u00e7\u00e3o financeira que forneceu o dinheiro para sua compra. O devedor fica na posse, mas s\u00f3 recebe a propriedade quando quita a d\u00edvida.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Quando esse bem \u00e9 um im\u00f3vel que se submete \u00e0 cobran\u00e7a de taxas de condom\u00ednio, a responsabilidade pelo pagamento \u00e9 do devedor fiduciante, apesar de o artigo 1.345 do <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/2002\/l10406compilada.htm\">C\u00f3digo Civil<\/a>\u00a0instituir que tal obriga\u00e7\u00e3o \u00e9 de responsabilidade do adquirente do im\u00f3vel \u2014 a rigor, o credor fiduci\u00e1rio, pelo menos enquanto o financiamento n\u00e3o for quitado. Essa regra de exce\u00e7\u00e3o consta do artigo 27, par\u00e1grafo 8\u00ba, da\u00a0<a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9514.htm\">Lei 9.514\/1997<\/a>.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A possibilidade de penhorar o im\u00f3vel alienado fiduciariamente para pagar as d\u00edvidas de taxa de condom\u00ednio \u00e9 tema que divide a doutrina, conforme destacou a ministra Nancy Andrighi, em seu voto. H\u00e1 duas poss\u00edveis solu\u00e7\u00f5es.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A primeira seria permitir a penhora do im\u00f3vel. O dinheiro da venda seria usado para pagar a d\u00edvida de condom\u00ednio. O restante seria entregue ao credor fiduci\u00e1rio. No que faltar para quitar o financiamento, caberia \u00e0 institui\u00e7\u00e3o financeira cobrar do devedor fiduciante por meio de a\u00e7\u00e3o de regresso.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A segunda sa\u00edda seria vetar a penhora do im\u00f3vel, proposta adotada pela relatora e encampada por unanimidade pela 3\u00aa Turma, ao interpretar a Lei 9.514\/1997.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cAo prever que o devedor fiduciante responde pelas despesas condominiais, a norma estabelece que o seu patrim\u00f4nio \u00e9 que ser\u00e1 usado para a satisfa\u00e7\u00e3o do referido cr\u00e9dito, n\u00e3o incluindo, portanto, o im\u00f3vel alienado fiduciariamente, que integra o patrim\u00f4nio do credor fiduci\u00e1rio\u201d, disse a ministra Nancy Andrighi.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O voto da relatora ainda aponta que uma sa\u00edda poss\u00edvel seria admitir a penhora do direito real de aquisi\u00e7\u00e3o do im\u00f3vel. Essa medida \u00e9 expressamente autorizada pelo artigo 835, inciso XII do C\u00f3digo de Processo Civil.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O direito real de aquisi\u00e7\u00e3o \u00e9 a expectativa de que a propriedade de um bem (o im\u00f3vel) vai se consolidar para uma pessoa (o comprador) uma vez cumprida uma condi\u00e7\u00e3o imposta (o pagamento do financiamento).<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cTodos os bens e direitos que integram o patrim\u00f4nio do devedor fiduciante respondem pela satisfa\u00e7\u00e3o da d\u00edvida condominial, no qual n\u00e3o est\u00e1 inclu\u00eddo o im\u00f3vel, mas est\u00e1 o direito real de aquisi\u00e7\u00e3o derivado da aliena\u00e7\u00e3o fiduci\u00e1ria (artigo 1.368-B,
