Bem de fam\u00edlia dado em garantia.<\/p>\n<p style=\"text-align: justify;\"><strong>Destaque:<\/strong> A oferta volunt\u00e1ria de seu \u00fanico im\u00f3vel residencial em garantia a um contrato de m\u00fatuo, favorecedor de pessoa jur\u00eddica em aliena\u00e7\u00e3o fiduci\u00e1ria, n\u00e3o conta com a prote\u00e7\u00e3o irrestrita do bem de fam\u00edlia.<\/p>\n<p style=\"text-align: justify;\"><strong>Informa\u00e7\u00f5es do inteiro teor:<\/strong> A controv\u00e9rsia diz respeito \u00e0 impenhorabilidade do bem de fam\u00edlia quando ocorrer a aliena\u00e7\u00e3o fiduci\u00e1ria de im\u00f3vel em opera\u00e7\u00e3o de empr\u00e9stimo banc\u00e1rio.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Rememora-se que o bem de fam\u00edlia e sua impenhorabilidade s\u00e3o regidos pela Lei n. 8.000\/1990 (art. 1\u00ba). O instituto visa assegurar ao indiv\u00edduo um patrim\u00f4nio m\u00ednimo, sendo tamb\u00e9m, express\u00e3o do princ\u00edpio da dignidade da pessoa humana, consagrado no art. 1\u00b0, III, da Constitui\u00e7\u00e3o Federal. Antes do advento da Lei n. 9.514\/1997 (que criou o Sistema Financeiro Imobili\u00e1rio e regulou o instituto da aliena\u00e7\u00e3o fiduci\u00e1ria de im\u00f3vel), a principal garantia dos financiamentos envolvendo bens im\u00f3veis era a hipoteca. Por tal raz\u00e3o, a Lei n. 8.009\/1990 somente disp\u00f4s sobre a hipoteca, prevendo a exce\u00e7\u00e3o do art. 3\u00ba, inciso V, que permitia a penhora de bem dado em hipoteca sobre o im\u00f3vel oferecido como garantia real pelo casal ou pela entidade familiar.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Esta Corte Superior, ao interpretar referida norma, concluiu que, na hip\u00f3tese de oferecimento de im\u00f3vel em garantia hipotec\u00e1ria, a impenhorabilidade do bem de fam\u00edlia somente estar\u00e1 comprometida se a d\u00edvida objeto dessa garantia tiver sido assumida em benef\u00edcio da pr\u00f3pria entidade familiar (EAREsp 848.498\/PR, relator Ministro Luis Felipe Salom\u00e3o, Segunda Se\u00e7\u00e3o, DJe de 7\/6\/2018).<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Por sua vez, o instituto da aliena\u00e7\u00e3o fiduci\u00e1ria foi introduzido na legisla\u00e7\u00e3o brasileira pela necessidade de superar a inadequa\u00e7\u00e3o da garantia hipotec\u00e1ria, que depende do Poder Judici\u00e1rio para a sua execu\u00e7\u00e3o. Com o intuito de permitir maior celeridade no recebimento do cr\u00e9dito, ampliando a circula\u00e7\u00e3o de recursos e a realiza\u00e7\u00e3o de neg\u00f3cios, a Lei n. 9.514\/1997 dispensou o ajuizamento de a\u00e7\u00e3o judicial, prevendo a consolida\u00e7\u00e3o da propriedade perante o oficial do Registro de Im\u00f3veis.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Segundo o rito previsto para o instituto, o devedor poder\u00e1 purgar a mora no prazo fixado, convalescendo o contrato de aliena\u00e7\u00e3o fiduci\u00e1ria (art. 25, \u00a7 5\u00ba, da Lei n. 9.514\/1997), caso em que n\u00e3o se consolida a propriedade em favor do credor. J\u00e1 na aliena\u00e7\u00e3o fiduci\u00e1ria, n\u00e3o se discute a &#8220;impenhorabilidade&#8221; do bem, uma vez que a propriedade foi transmitida, ainda que em car\u00e1ter resol\u00favel, pelos devedores. Cumpre-se verificar, isto sim, a &#8220;alienabilidade&#8221; do bem.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Nesse sentido, a Terceira Turma ao distinguir o bem de fam\u00edlia legal (disciplinado na Lei n. 8.009\/1990) e o bem de fam\u00edlia volunt\u00e1rio (estabelecido pelo C\u00f3digo Civil, nos arts. 1.711 a 1.722), concluiu pela possibilidade de aliena\u00e7\u00e3o fiduci\u00e1ria do bem de fam\u00edlia legal: &#8220;a pr\u00f3pria Lei n. 8.009\/1990, com o escopo de proteger o bem destinado \u00e0 resid\u00eancia familiar, aduz que o im\u00f3vel assim categorizado n\u00e3o responder\u00e1 por qualquer tipo de d\u00edvida civil, comercial, fiscal, previdenci\u00e1ria ou de outra natureza, mas em nenhuma passagem disp\u00f5e que tal bem n\u00e3o possa ser alienado pelo seu propriet\u00e1rio&#8221; (REsp 1.560.562\/SC, relatora Ministra Nancy Andrighi, Terceira Turma, julgado em 2\/4\/2019, DJe de 4\/4\/2019).<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Desse modo, n\u00e3o se afigura poss\u00edvel beneficiar aquele que, com reserva mental, ofereceu em garantia im\u00f3vel de sua propriedade, por meio de aliena\u00e7\u00e3o fiduci\u00e1ria, a fim de obter recursos em contrato de m\u00fatuo sob condi\u00e7\u00f5es mais favor\u00e1veis e, em momento posterior, ap\u00f3s o inadimplemento da d\u00edvida, alega a invalidade do ato de disposi\u00e7\u00e3o em raz\u00e3o da prote\u00e7\u00e3o conferida ao bem de fam\u00edlia.<\/p>\n<p style=\"text-align: justify;\"><em><strong>Fonte<\/strong>: Informativo
