Quando falamos de pequenas propriedades, \u00e9 necess\u00e1rio falar sobre o parcelamento do solo urbano, j\u00e1 que est\u00e1 diretamente ligado a essas propriedades\u201d, comentou. \u201cHoje, o Brasil \u00e9, sem d\u00favidas, uma grande reuni\u00e3o de pequenas propriedades. Esse feito deve ser creditado principalmente aos pequenos loteadores, registradores de im\u00f3veis e not\u00e1rios\u201d.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cParcelar o solo nada mais \u00e9 do que dividi-lo em unidades aut\u00f4nomas menores, cada qual com sua pr\u00f3pria matr\u00edcula imobili\u00e1ria. Embora a Lei 6766\/79 n\u00e3o defina, expressamente, o que \u00e9 esse parcelamento, ela estabelece, j\u00e1 em seu artigo 2\u00ba, que ele \u201cpoder\u00e1 ser feito mediante loteamento ou desmembramento, observadas as disposi\u00e7\u00f5es desta Lei e as das legisla\u00e7\u00f5es estaduais e municipais pertinentes\u201d\u201d, explicou Amadei.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Em 2022, a Lei 14.382, que veio por convers\u00e3o da Medida Provis\u00f3ria 1.085, trouxe duas novidades. De acordo com o desembargador, algumas altera\u00e7\u00f5es foram pontuais em rela\u00e7\u00e3o \u00e0 Lei 6766 e outras que provocam reflex\u00f5es a respeito de como ficar\u00e1 o registro do parcelamento do solo urbano a partir dessas mudan\u00e7as.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cSabemos que a lei buscou consolidar, modernizar e simplificar os procedimentos feitos de modo eletr\u00f4nico. Podemos afirmar que, diante desse cen\u00e1rio mais digital, sem d\u00favida haver\u00e1 interfer\u00eancia no servi\u00e7o de registro de loteamento\u201d, comentou. Segundo ele, uma mudan\u00e7a significativa trazida pela lei atual \u00e9 a altera\u00e7\u00e3o no prazo da qualifica\u00e7\u00e3o registral, agora sendo de 10 dias. \u201cJ\u00e1 a qualifica\u00e7\u00e3o registral de loteamento, n\u00e3o h\u00e1 altera\u00e7\u00f5es trazidas pela lei, sendo mantido o prazo de 15 dias\u201d.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Outro t\u00f3pico citado pelo expositor diz respeito \u00e0s circunscri\u00e7\u00f5es imobili\u00e1rias de registro dos lotes. \u201cOriginalmente, os im\u00f3veis que pertenciam a mais de uma circunscri\u00e7\u00e3o imobili\u00e1ria precisavam ter a matr\u00edcula registrada nas duas serventias. A Lei 14.382 vem para dizer que, embora tenhamos a multiplicidade das matr\u00edculas, o registro passa a ser feito em apenas um cart\u00f3rio de notas em que a \u00e1rea for maior, trazendo, ent\u00e3o, um conceito de unicidade da matr\u00edcula\u201d, explicou. \u201cNo caso do loteamento, a matr\u00edcula segue sendo feita primeiramente no cart\u00f3rio onde h\u00e1 a maior \u00e1rea e, sucessivamente, nos cart\u00f3rios onde a \u00e1rea \u00e9 menor. A meu ver, esse artigo, origin\u00e1rio da Lei 6766 n\u00e3o foi revogado pela 14.382\u201d, completou Vicente de Abreu Amadei.<\/p>\n<p style=\"text-align: justify;\"><a
