{"id":3160,"date":"2019-05-31T10:07:58","date_gmt":"2019-05-31T14:07:58","guid":{"rendered":"http:\/\/www.anoregmt.org.br\/novo\/?p=3160"},"modified":"2019-05-31T10:07:58","modified_gmt":"2019-05-31T14:07:58","slug":"corregedor-determina-que-notarios-reconhecam-usucapiao-extrajudicial","status":"publish","type":"post","link":"https:\/\/www.anoregmt.org.br\/novo\/corregedor-determina-que-notarios-reconhecam-usucapiao-extrajudicial\/","title":{"rendered":"Corregedor determina que not\u00e1rios reconhe\u00e7am usucapi\u00e3o extrajudicial"},"content":{"rendered":"<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Atendendo pedido feito pela Ordem dos Advogados do Brasil \u2013 Se\u00e7\u00e3o Goi\u00e1s (OAB-GO), o corregedor-geral da Justi\u00e7a de Goi\u00e1s, desembargador Kisleu Dias Maciel Filho, determinou que os not\u00e1rios de Goi\u00e1s devem reconhecer usucapi\u00e3o extrajudicial, ainda que a mat\u00e9ria n\u00e3o tenha sido regulamentada no Estado, pois est\u00e1 em vigor provimento do Conselho Nacional de Justi\u00e7a (CNJ) que trata sobre o tema.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O caso foi levado \u00e0 CGJ pela Procuradoria de Prerrogativas da OAB-GO, ap\u00f3s provoca\u00e7\u00e3o da subse\u00e7\u00e3o de Piracanjuba, que pedia para que os cart\u00f3rios passassem a cumprir a determina\u00e7\u00e3o do CNJ. No documento, assinado pelo presidente L\u00facio Fl\u00e1vio de Paiva, e pelo presidente da Comiss\u00e3o de Direitos e Prerrogativa, David Soares, sustentam que o reconhecimento extrajudicial de usucapi\u00e3o ser\u00e1 processado diretamente perante o Cart\u00f3rio do Registro de im\u00f3veis da comarca em que estiver situado o im\u00f3vel.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Da mesma forma, alega a OAB-GO, o CNJ editou o Provimento n\u00b0 65 de 14 de dezembro de 2017, estabelecendo diretrizes para o procedimento da usucapi\u00e3o extrajudicial nos servi\u00e7os notariais de registro de im\u00f3veis. \u201cMas um grande n\u00famero de cart\u00f3rios, podendo citar o de Piracanjuba, Jaragu\u00e1, Luzi\u00e2nia, Goian\u00e9sia, vinham se negando a proceder a usucapi\u00e3o no \u00e2mbito administrativo, sob a alega\u00e7\u00e3o de que a Corregedoria Geral de Justi\u00e7a n\u00e3o regulou e nem criou selo para tal, sendo esse um impedimento \u00e0 advocacia\u201d.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O corregedor, por sua vez, determinou expedi\u00e7\u00e3o de of\u00edcio circular aos diretores de Foro e tamb\u00e9m aos not\u00e1rios e registradores do Estado de Goi\u00e1s, reiterando que deve ser dado cumprimento \u00e0s disposi\u00e7\u00f5es do provimento do CNJ, devendo ser apurada de forma individualizada eventual renit\u00eancia na sua aplica\u00e7\u00e3o.
