JUSTI\u00c7A<\/strong>, usando de suas atribui\u00e7\u00f5es constitucionais, legais e regimentais, bem como:<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0 \u00a0 \u00a0CONSIDERANDO<\/strong>\u00a0os direitos da personalidade enquanto direitos fundamentais;<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0 \u00a0 \u00a0CONSIDERANDO<\/strong>\u00a0que toda pessoa tem direito ao nome, nele compreendidos o prenome e o sobrenome (<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/2002\/l10406compilada.htm#:~:text=LEI%20N%C2%BA%2010.406%2C%20DE%2010%20DE%20JANEIRO%20DE%202002&amp;text=Institui%20o%20C%C3%B3digo%20Civil.&amp;text=Art.,e%20deveres%20na%20ordem%20civil.\" target=\"_blank\" rel=\"noopener\">Lei n. 10.406\/2002, artigo 16<\/a>); e<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0 \u00a0 \u00a0CONSIDERANDO<\/strong>\u00a0que a\u00a0<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2019\/lei\/L13846.htm\" target=\"_blank\" rel=\"noopener\">Lei n. 13.846\/2019<\/a>, de cunho previdenci\u00e1rio, alterou a\u00a0<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8212cons.htm\" target=\"_blank\" rel=\"noopener\">Lei n. 8.212\/1991<\/a>, mas n\u00e3o alterou a\u00a0<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l6015compilada.htm\" target=\"_blank\" rel=\"noopener\">Lei n. 6.015\/1973<\/a>\u00a0no que tange aos requisitos para lavratura do assento de nascimento ou para registro de crian\u00e7a nascida morta,<\/p>\n<p style=\"text-align: justify;\"><strong>\u00a0 \u00a0 \u00a0RESOLVE<\/strong>:<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Art. 1\u00ba Recomendar aos registradores civis que promovam o registro de nascimento e de natimorto, independentemente da apresenta\u00e7\u00e3o dos n\u00fameros de inscri\u00e7\u00e3o no CPF dos respectivos pais (biol\u00f3gicos ou socioafetivos), ofertando prioridade \u00e0 erradica\u00e7\u00e3o do sub-registro.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Art. 2\u00ba Recomendar que, nas situa\u00e7\u00f5es em que os pais do registrando n\u00e3o estejam previamente cadastrados na base de dados da Receita Federal do Brasil, os oficiais de registro providenciem o assento de nascimento ou o registro de \u00f3bito exclusivamente \u00e0 vista dos elementos essenciais descritos nos <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l6015compilada.htm\" target=\"_blank\" rel=\"noopener\">n\u00fameros 1 a 11 do artigo 54 da Lei n. 6.015\/1973<\/a>, com observ\u00e2ncia do regramento constante do\u00a0<a href=\"https:\/\/atos.cnj.jus.br\/atos\/detalhar\/2525\" target=\"_blank\" rel=\"noopener\">Provimento CNJ n. 63\/2017<\/a>\u00a0e da\u00a0<a href=\"https:\/\/atos.cnj.jus.br\/atos\/detalhar\/2939\" target=\"_blank\" rel=\"noopener\">Recomenda\u00e7\u00e3o CN n. 38\/2019<\/a>.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Art. 3\u00ba Esta Recomenda\u00e7\u00e3o entra em vigor na
