{"id":28164,"date":"2022-02-03T14:39:44","date_gmt":"2022-02-03T18:39:44","guid":{"rendered":"https:\/\/www.anoregmt.org.br\/novo\/?p=28164"},"modified":"2022-02-03T14:39:44","modified_gmt":"2022-02-03T18:39:44","slug":"locatario-do-imovel-nao-responde-por-taxa-de-ocupacao-apos-a-consolidacao-da-propriedade-fiduciaria","status":"publish","type":"post","link":"https:\/\/www.anoregmt.org.br\/novo\/locatario-do-imovel-nao-responde-por-taxa-de-ocupacao-apos-a-consolidacao-da-propriedade-fiduciaria\/","title":{"rendered":"Locat\u00e1rio do im\u00f3vel n\u00e3o responde por taxa de ocupa\u00e7\u00e3o ap\u00f3s a consolida\u00e7\u00e3o da propriedade fiduci\u00e1ria"},"content":{"rendered":"<div id=\"corpoDaNoticiaBox\" class=\"conteudo_texto\">\n<div id=\"ctl00_PlaceHolderMain_ctl05__ControlWrapper_RichHtmlField\" class=\"ms-rtestate-field\" aria-labelledby=\"ctl00_PlaceHolderMain_ctl05_label\">\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O locat\u00e1rio do im\u00f3vel cuja propriedade foi consolidada pelo credor fiduci\u00e1rio em raz\u00e3o da inadimpl\u00eancia do devedor fiduciante \u2013 antigo locador do bem \u2013 n\u00e3o \u00e9 parte leg\u00edtima para responder pela taxa de ocupa\u00e7\u00e3o prevista no <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9514.htm#art37A\" target=\"_blank\" rel=\"noopener\">artigo 37-A da Lei 9.514\/1997<\/a>, por n\u00e3o fazer parte da rela\u00e7\u00e3o jur\u00eddica que fundamentou a sua cobran\u00e7a.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A tese foi fixada pela Quarta Turma do Superior Tribunal de Justi\u00e7a (STJ) ao confirmar ac\u00f3rd\u00e3o do Tribunal de Justi\u00e7a de S\u00e3o Paulo (TJSP) segundo o qual o devedor fiduciante tem legitimidade restrita para responder pela taxa de ocupa\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A controv\u00e9rsia teve origem em a\u00e7\u00e3o de cobran\u00e7a proposta por um banco com o objetivo de receber a taxa de ocupa\u00e7\u00e3o, como forma de compensa\u00e7\u00e3o pelo per\u00edodo em que o r\u00e9u teria ocupado indevidamente um im\u00f3vel dado em garantia fiduci\u00e1ria de c\u00e9dula de cr\u00e9dito banc\u00e1rio celebrada com terceiros.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Diante da inadimpl\u00eancia dos devedores fiduciantes, o banco consolidou a propriedade do im\u00f3vel para si. Ao tentar exercer a posse do bem, contudo, a institui\u00e7\u00e3o ficou sabendo que ele havia sido locado pelo antigo propriet\u00e1rio, fato que motivou a notifica\u00e7\u00e3o do locat\u00e1rio para que desocupasse o im\u00f3vel \u2013 o que s\u00f3 veio a ocorrer 246 dias depois. Por essa raz\u00e3o, o banco pediu judicialmente que o \u00faltimo morador arcasse com a taxa de ocupa\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O ju\u00edzo de primeiro grau, aplicando a teoria da asser\u00e7\u00e3o, reconheceu a ilegitimidade passiva do locat\u00e1rio do im\u00f3vel e julgou improcedente o pedido. A senten\u00e7a foi mantida pelo TJSP.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0No recurso especial apresentado ao STJ, a institui\u00e7\u00e3o financeira alegou que a legisla\u00e7\u00e3o n\u00e3o veda a cobran\u00e7a da taxa de ocupa\u00e7\u00e3o diretamente do sucessor do devedor fiduciante, tendo em vista a necessidade de justa contrapresta\u00e7\u00e3o por uso e frui\u00e7\u00e3o do bem.<\/p>\n<p style=\"text-align: justify;\"><strong>Compensa\u00e7\u00e3o por ocupa\u00e7\u00e3o ileg\u00edtima de im\u00f3vel<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Segundo o relator, ministro Antonio Carlos Ferreira, a taxa de ocupa\u00e7\u00e3o tem por fundamento a posse injusta exercida pelo devedor fiduciante a partir do momento em que \u00e9 consolidada a propriedade no patrim\u00f4nio do credor, sendo sua finalidade compensar o leg\u00edtimo propriet\u00e1rio \u2013 o credor fiduci\u00e1rio, ou quem vier a suced\u00ea-lo \u2013 pela ocupa\u00e7\u00e3o ileg\u00edtima.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Nesse contexto, observou o magistrado, &#8220;os sujeitos da rela\u00e7\u00e3o jur\u00eddica apta a ensejar a cobran\u00e7a da taxa de ocupa\u00e7\u00e3o prevista no artigo 37-A da Lei 9.514\/1997 est\u00e3o expressos na norma e s\u00e3o apenas os sujeitos origin\u00e1rios do ajuste \u2013 fiduciante e fiduci\u00e1rio \u2013, ou aqueles que sucederam o credor na rela\u00e7\u00e3o contratual&#8221;.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Por essas raz\u00f5es, Antonio Carlos Ferreira apontou que o TJSP manteve corretamente a senten\u00e7a de improced\u00eancia da a\u00e7\u00e3o ajuizada pelo banco, tendo em vista que o \u00f4nus do pagamento da taxa de ocupa\u00e7\u00e3o s\u00f3 poderia ser atribu\u00eddo ao devedor fiduciante, sendo o locat\u00e1rio parte ileg\u00edtima para responder pela cobran\u00e7a.<\/p>\n<p style=\"text-align: justify;\"><strong>Credor fiduci\u00e1rio pode suceder locador<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Ao negar provimento ao recurso especial, o ministro destacou que a cess\u00e3o da posse do im\u00f3vel objeto de aliena\u00e7\u00e3o fiduci\u00e1ria, por meio da celebra\u00e7\u00e3o de contrato de loca\u00e7\u00e3o com terceiros, \u00e9 uma faculdade assegurada ao devedor fiduciante pelo <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l9514.htm#art24\" target=\"_blank\" rel=\"noopener\">artigo 24, inciso V, da Lei 9.514\/1997<\/a>, pois, enquanto estiver adimplente, ele poder\u00e1 usar livremente o im\u00f3vel, por sua conta e risco.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0No entanto, o relator destacou que, se houve a anu\u00eancia do credor com a loca\u00e7\u00e3o, esta dever\u00e1 ser respeitada nas condi\u00e7\u00f5es do contrato, passando o credor a figurar na rela\u00e7\u00e3o locat\u00edcia como sucessor do locador. Nesse caso, concluiu, os valores que o credor cobrar\u00e1 do ocupante do im\u00f3vel, ap\u00f3s a consolida\u00e7\u00e3o da propriedade, devem ser aqueles decorrentes do contrato de loca\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\"><a
