Atualmente, c\u00f4njuges casados sob regime de comunh\u00e3o universal de bens ou de separa\u00e7\u00e3o obrigat\u00f3ria n\u00e3o podem ser s\u00f3cios em empresas. Proposto em agosto deste ano, o PL ainda aguarda distribui\u00e7\u00e3o \u00e0s Comiss\u00f5es.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Segundo o Senador, os defensores da proibi\u00e7\u00e3o de sociedade empresarial entre c\u00f4njuges sob esses regimes argumentam, em geral, que a limita\u00e7\u00e3o busca evitar confus\u00f5es patrimoniais prejudiciais aos credores, sejam elas intencionais ou acidentais. Contudo, afirma que n\u00e3o h\u00e1, na pr\u00e1tica, um preju\u00edzo concreto e suficiente aos credores e que esta limita\u00e7\u00e3o afronta a <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/_ato2019-2022\/2019\/lei\/L13874.htm\">Lei de Liberdade Econ\u00f4mica<\/a>. De acordo com Amim, os credores continuariam podendo cobrar do patrim\u00f4nio l\u00edquido da empresa para a satisfa\u00e7\u00e3o de seus cr\u00e9ditos, independentemente de as cotas sociais serem compartilhadas ou n\u00e3o no \u00e2mbito marital. \u201cAl\u00e9m disso, eventual divis\u00e3o de bens advinda de div\u00f3rcio n\u00e3o encontraria obst\u00e1culos em divisar os valores das cotas de cada c\u00f4njuge-s\u00f3cio, que s\u00e3o devidamente registradas e atualizadas nos livros empresariais\u201d, destacou o Senador.<\/p>\n<p style=\"text-align: justify;\"><a
