{"id":23853,"date":"2021-07-12T13:36:29","date_gmt":"2021-07-12T17:36:29","guid":{"rendered":"https:\/\/www.anoregmt.org.br\/novo\/?p=23853"},"modified":"2021-07-12T13:36:29","modified_gmt":"2021-07-12T17:36:29","slug":"provimento-no-120-cnj-altera-o-provimento-no-103-para-permitir-a-emissao-virtual-da-autorizacao-eletronica-de-viagem-aev","status":"publish","type":"post","link":"https:\/\/www.anoregmt.org.br\/novo\/provimento-no-120-cnj-altera-o-provimento-no-103-para-permitir-a-emissao-virtual-da-autorizacao-eletronica-de-viagem-aev\/","title":{"rendered":"Provimento n\u00ba 120 CNJ altera o Provimento n\u00ba 103 para permitir a emiss\u00e3o virtual da Autoriza\u00e7\u00e3o Eletr\u00f4nica de Viagem (AEV)"},"content":{"rendered":"<p><strong>PROVIMENTO N\u00ba 120, DE 8 DE JULHO DE 2021.<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Altera o Provimento n\u00ba 103, de 4 de junho de 2020, que disp\u00f5e sobre a Autoriza\u00e7\u00e3o Eletr\u00f4nica de Viagem (AEV) nacional e internacional de crian\u00e7as e adolescentes at\u00e9 16 (dezesseis) anos desacompanhados de ambos ou um de seus pais e d\u00e1 outras provid\u00eancias.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A CORREGEDORA NACIONAL DE JUSTI\u00c7A, usando de suas atribui\u00e7\u00f5es constitucionais, legais e regimentais, CONSIDERANDO a decis\u00e3o proferida nos autos do Pedido de Provid\u00eancias n\u00ba 0005071-75.2021.2.00.0000, que acolheu as sugest\u00f5es de reda\u00e7\u00e3o propostas pelo Col\u00e9gio Notarial do Brasil \u2013 Conselho Federal para os artigos 4\u00ba e 6\u00ba, ambos do Provimento CNJ n\u00ba 103\/2020, visando tornar a ferramenta mais acess\u00edvel aos usu\u00e1rios e buscando evitar d\u00favidas jur\u00eddicas relacionadas \u00e0 natureza do ato praticado;<\/p>\n<p style=\"text-align: justify;\"><strong>RESOLVE:<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Art. 1\u00ba O caput do art. 4\u00ba e o caput do art. 6\u00ba do Provimento n\u00ba 103, de 4 de junho de 2020, passam a vigorar com a seguinte reda\u00e7\u00e3o:<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0<em>\u201cArt. 4\u00ba Os pais ou respons\u00e1veis, nas hip\u00f3teses em que n\u00e3o seja necess\u00e1ria a autoriza\u00e7\u00e3o judicial, poder\u00e3o autorizar a viagem da crian\u00e7a e do adolescente por instrumento particular eletr\u00f4nico, com firma reconhecida por autenticidade por um tabeli\u00e3o de notas, nos termos do art. 8\u00ba da Resolu\u00e7\u00e3o CNJ n. 131, de 26 de maio de 2011, e do art. 2\u00ba da Resolu\u00e7\u00e3o CNJ n. 295, de 13 de setembro de 2019. (NR)<\/em><\/p>\n<p style=\"text-align: justify;\"><em>\u00a0 \u00a0 \u00a0Art. 6\u00ba Para a assinatura da Autoriza\u00e7\u00e3o Eletr\u00f4nica de Viagem \u00e9 imprescind\u00edvel a realiza\u00e7\u00e3o de videoconfer\u00eancia notarial para confirma\u00e7\u00e3o da identidade e da autoria daquele que assina, a utiliza\u00e7\u00e3o da assinatura digital notarizada pelas partes e a assinatura do Tabeli\u00e3o de Notas com o uso do certificado digital, segundo a Infraestrutura de Chaves P\u00fablicas Brasileira \u2013 ICP.
