O Ac\u00f3rd\u00e3o teve como Relator o Ministro\u00a0Ricardo Lewandowski. A ADI foi ajuizada pela Procuradoria da Rep\u00fablica (PGR) contra o art. 98 da\u00a0<a href=\"https:\/\/www.ageprev.ms.gov.br\/wp-content\/uploads\/2020\/05\/LEI-N%C2%BA-3.150-DE-22_12_2005.pdf\">Lei Estadual n. 3.150\/2005<\/a>.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0De acordo com o <em>site\u00a0<\/em>do STF, o Ministro Relator destacou o entendimento firme da Corte no sentido de que o regime previdenci\u00e1rio pr\u00f3prio dos Servidores P\u00fablicos (art. 40 da\u00a0<a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/constituicao\/ConstituicaoCompilado.htm\">Constitui\u00e7\u00e3o Federal<\/a>) n\u00e3o se aplica aos Auxiliares da Justi\u00e7a, que n\u00e3o s\u00e3o detentores de cargo p\u00fablico efetivo. Resguarda-se, entretanto, o direito dos Not\u00e1rios e Registradores que tenham reunido os requisitos necess\u00e1rios \u00e0 aposentadoria antes das altera\u00e7\u00f5es promovidas pela Reforma da Previd\u00eancia de 1998 (Emenda Constitucional 20\/1998).<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Em seu Voto, o Ministro Relator ainda fez refer\u00eancia \u00e0 precedente em caso an\u00e1logo, ocorrido no Paran\u00e1 (ADI 2791), onde se decidiu pela inconstitucionalidade de artigo de Lei Estadual, com base no entendimento de que o Estado-Membro n\u00e3o pode conceder aos Serventu\u00e1rios da Justi\u00e7a aposentadoria em regime id\u00eantico ao dos servidores p\u00fablicos. Ressaltou, ainda, que, com rela\u00e7\u00e3o aos servidores sem v\u00ednculo efetivo, a Corte j\u00e1 decidiu que o art. 40, \u00a7 13, da Constitui\u00e7\u00e3o Federal determinou sua
