Exercem papel fundamental ao registro de c\u00e9dulas de cr\u00e9dito ligadas ao setor, como a C\u00e9dula de Produto Rural (CPR) e a C\u00e9dula Imobili\u00e1ria Rural (CIR).<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Em 2019, estima-se que o Registro de Im\u00f3veis movimentou R$ 181 bilh\u00f5es em garantias para o setor rural. N\u00famero que deve crescer ainda mais este ano pela facilidade da Central Eletr\u00f4nica de Integra\u00e7\u00e3o e Informa\u00e7\u00f5es dos Servi\u00e7os Notariais e Registrais do Estado de Mato Grosso \u2013 CEI\/MT \u2013 em fornecer todas informa\u00e7\u00f5es relativas a direitos reais das propriedades privadas, garantindo a seguran\u00e7a para aqueles que as adquirem.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Por meio do Registro de Im\u00f3veis, o produtor rural pode promover a regulariza\u00e7\u00e3o fundi\u00e1ria do seu im\u00f3vel por meio da usucapi\u00e3o extrajudicial e, ap\u00f3s a regulariza\u00e7\u00e3o dominial, ter acesso a empr\u00e9stimos com juros mais baixos. No cart\u00f3rio tamb\u00e9m s\u00e3o realizadas as averba\u00e7\u00f5es das certifica\u00e7\u00f5es de georreferenciamento, medida essencial para obten\u00e7\u00e3o de cr\u00e9dito, aliena\u00e7\u00e3o do bem, regulariza\u00e7\u00e3o ambiental, entre outros.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O trabalhador que tem sua propriedade regularizada junto aos Cart\u00f3rios de Registro de Im\u00f3veis disp\u00f5e de v\u00e1rios benef\u00edcios, uma vez que os documentos emitidos s\u00e3o exig\u00eancias b\u00e1sicas em qualquer transa\u00e7\u00e3o que os envolva. A formaliza\u00e7\u00e3o tamb\u00e9m oferece mais seguran\u00e7a aos credores rurais, que exp\u00f5e seu capital a risco, e se esfor\u00e7am para ter garantias em caso de eventual inadimpl\u00eancia, tornando poss\u00edvel o recebimento do valor emprestado, dos juros e das despesas. Sendo quanto maior a garantia, menor o risco para o credor, e, por consequ\u00eancia, menores as taxas de juros para os produtores.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Al\u00e9m da garantia sobre bens m\u00f3veis, o registro imobili\u00e1rio tamb\u00e9m \u00e9 ben\u00e9fico pela certeza na identifica\u00e7\u00e3o de onde o registro pode ser feito e divulgado, em virtude do princ\u00edpio da territorialidade. Ou seja, n\u00e3o importa o local onde contrato \u00e9 estabelecido, pois obrigatoriamente o registro dever\u00e1 ocorrer no Cart\u00f3rio de Registro de Im\u00f3veis da localiza\u00e7\u00e3o do bem.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Confira as formas de garantias oferecidas pelo Cart\u00f3rios de Registro de Im\u00f3veis que contribuem com o Agroneg\u00f3cio:<\/p>\n<p style=\"text-align: justify;\"><strong>Penhor:<\/strong>\u00a0t\u00edtulo registrado na matr\u00edcula do im\u00f3vel de produ\u00e7\u00e3o da safra ou de localiza\u00e7\u00e3o do bem. \u00c9 respons\u00e1vel por vincular um bem m\u00f3vel, como uma lavoura a ser implantada, maquin\u00e1rios agr\u00edcolas, entre outros. O bem, que continua na posse do devedor, fica vinculado ao cumprimento da obriga\u00e7\u00e3o, sendo que n\u00e3o poder\u00e1 ser vendido ou transferido a terceiros sem o conhecimento e concord\u00e2ncia do credor.<\/p>\n<p style=\"text-align: justify;\"><strong>Hipoteca:<\/strong>\u00a0possui validade de 30 anos e vincula um bem im\u00f3vel (ou outros que a lei espec\u00edfica) at\u00e9 a liquida\u00e7\u00e3o do d\u00e9bito, sendo que o registro (cuja ordem garante a prefer\u00eancia do no recebimento do cr\u00e9dito) deve ser realizado junto \u00e0 matr\u00edcula de tal bem, que pode ser hipotecado mais de uma vez para o mesmo credor ou para credores diferentes. O registro da hipoteca confere prefer\u00eancia ao credor quanto ao recebimento do cr\u00e9dito. Assim, havendo v\u00e1rias hipotecas, o credor cuja hipoteca foi registrada em primeiro lugar ter\u00e1 prefer\u00eancia no recebimento do cr\u00e9dito.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u00c9 muito comum a constitui\u00e7\u00e3o de hipoteca oferecida por terceiro, chamado de garantidor hipotec\u00e1rio, que concorda em oferecer seu patrim\u00f4nio para garantia do pagamento do d\u00e9bito do emitente. Ressalte-se que neste caso o terceiro garantidor n\u00e3o responde pessoalmente pelo pagamento do d\u00e9bito, mas t\u00e3o somente nos limites da propriedade hipotecada.<\/p>\n<p style=\"text-align: justify;\"><strong>Aliena\u00e7\u00e3o fiduci\u00e1ria:<\/strong>\u00a0pode ser aplicada tanto a bens m\u00f3veis quanto a im\u00f3veis. Trata-se de garantia mais agressiva na medida em que o devedor transfere a propriedade para o credor, sendo que somente com o pagamento da d\u00edvida e dos encargos \u00e9 que a propriedade ficar\u00e1 livre para o devedor.<\/p>\n<p style=\"text-align: justify;\"><strong>Patrim\u00f4nio de afeta\u00e7\u00e3o:<\/strong>\u00a0consiste na segrega\u00e7\u00e3o de determinados bens do incorporador para constitui\u00e7\u00e3o de um patrim\u00f4nio distinto, que n\u00e3o responde por outras d\u00edvidas e obriga\u00e7\u00f5es, somente referentes ao empreendimento. Essa forma visa garantir ao produtor rural o direito de segregar o im\u00f3vel rural de sua propriedade (ou fra\u00e7\u00e3o dele), bem como as acess\u00f5es e as benfeitorias nele fixadas para servir de garantia de opera\u00e7\u00f5es de cr\u00e9dito lastreadas em C\u00e9dula de Produto Rural (CPR) ou em opera\u00e7\u00f5es financeiras contratadas por meio da C\u00e9dula Imobili\u00e1ria Rural (CIR), que dever\u00e1 ser registrada no cart\u00f3rio de registro de im\u00f3veis.<\/p>\n<p style=\"text-align: justify;\"><strong>Sobre a Anoreg\/MT<\/strong><\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0A Associa\u00e7\u00e3o dos Not\u00e1rios e Registradores do Estado de Mato Grosso (ANOREG\/MT) congrega os 261 Cart\u00f3rios distribu\u00eddos em todos os munic\u00edpios do Estado.
