O texto altera a Lei&nbsp;<a href=\"http:\/\/www2.camara.leg.br\/legin\/fed\/lei\/1960-1969\/lei-4591-16-dezembro-1964-368909-norma-pl.html\" target=\"_blank\" rel=\"noopener noreferrer\">4.591\/1964<\/a>, que trata do condom&iacute;nio em edifica&ccedil;&otilde;es e das incorpora&ccedil;&otilde;es imobili&aacute;rias.<\/p>\n<div id=\"fotoNoticia\" style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Hoje, a norma prev&ecirc; que uma comiss&atilde;o de representantes dos adquirentes ser&aacute; designada no contrato de constru&ccedil;&atilde;o, de incorpora&ccedil;&atilde;o ou eleita em assembleia para representar os adquirentes em tudo o que interessar ao bom andamento da obra, ou para praticar os atos relacionados com o chamado patrim&ocirc;nio de afeta&ccedil;&atilde;o.<\/div>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Para tornar mais efetivo o funcionamento da comiss&atilde;o, a proposta prev&ecirc; regra de convoca&ccedil;&atilde;o para que os adquirentes possam acompanhar o andamento da obra de acordo com a previs&atilde;o contratual.<\/p>\n<p style=\"text-align: justify;\"><strong>Projeto original<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; O texto aprovado &eacute; o substitutivo do relator, deputado Celso Russomanno (PRB-SP), ao Projeto de Lei&nbsp;<a href=\"http:\/\/www2.camara.leg.br\/camaranoticias\/noticias\/INDUSTRIA-E-COMERCIO\/446888-PROPOSTA-SUBMETE-TODA-INCORPORACAO-IMOBILIARIA-AO-REGIME-DE-AFETACAO.html\" target=\"_blank\" rel=\"noopener noreferrer\">5092\/2013<\/a>, do ex-deputado Wellington Fagundes, que tem como objetivo tornar obrigat&oacute;ria a institui&ccedil;&atilde;o de patrim&ocirc;nio de afeta&ccedil;&atilde;o &ndash; hoje facultativo &ndash; pelas incorpora&ccedil;&otilde;es imobili&aacute;rias.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; A figura jur&iacute;dica do patrim&ocirc;nio de afeta&ccedil;&atilde;o estabelece que os terrenos e as acess&otilde;es objeto de incorpora&ccedil;&atilde;o imobili&aacute;ria, bem como os demais bens e direitos a ela vinculados, ser&atilde;o mantidos apartados do patrim&ocirc;nio do incorporador e constituir&atilde;o patrim&ocirc;nio de afeta&ccedil;&atilde;o, destinado &agrave; consecu&ccedil;&atilde;o da incorpora&ccedil;&atilde;o e &agrave; entrega das unidades imobili&aacute;rias aos adquirentes.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; O relator entendeu, por&eacute;m, que a obrigatoriedade da institui&ccedil;&atilde;o de patrim&ocirc;nio de afeta&ccedil;&atilde;o para todas as incorpora&ccedil;&otilde;es e empreendimentos de parcelamento do solo poderia ter um efeito inverso e prejudicar os consumidores brasileiros.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;As pequenas e m&eacute;dias empresas da constru&ccedil;&atilde;o civil ter&atilde;o grande dificuldade de adaptar seus modelos de neg&oacute;cios a essa nova exig&ecirc;ncia, com procedimentos burocr&aacute;ticos complexos e onerosos&rdquo;, disse. &ldquo;Deve-se, portanto, prestigiar a autorregular&atilde;o do mercado, nessa situa&ccedil;&atilde;o&rdquo;, completou.<\/p>\n<p style=\"text-align: justify;\"><strong>Regra de convoca&ccedil;&atilde;o&nbsp;<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Celso Russomanno preferiu, portanto, aperfei&ccedil;oar a figura da comiss&atilde;o de representantes prevista na Lei 4.591\/64. Hoje a lei determina que o registro da incorpora&ccedil;&atilde;o ser&aacute; v&aacute;lido pelo prazo de 120 dias. Terminado o prazo, se o registro ainda n&atilde;o se houver concretizado, o incorporador s&oacute; poder&aacute; negociar unidades depois de atualizar a documenta&ccedil;&atilde;o, revalidando o registro por igual prazo.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Pela regra prevista no substitutivo, decorrido esse prazo fixado na lei, se a obra estiver sujeita ao patrim&ocirc;nio de afeta&ccedil;&atilde;o, o incorporador dever&aacute;:<\/p>\n<p style=\"text-align: justify;\">&ndash; proceder &agrave; convoca&ccedil;&atilde;o da assembleia de adquirentes visando &agrave; constitui&ccedil;&atilde;o da comiss&atilde;o de representantes; e<br \/>\n&ndash; quando houver financiamento destinado &agrave; produ&ccedil;&atilde;o, dar ci&ecirc;ncia &agrave; institui&ccedil;&atilde;o financeira da constitui&ccedil;&atilde;o da comiss&atilde;o de representantes e convoc&aacute;-la para as reuni&otilde;es, por meio de correspond&ecirc;ncia com aviso de recebimento, facultado o seu comparecimento da institui&ccedil;&atilde;o &agrave;s reuni&otilde;es.<\/p>\n<p style=\"text-align: justify;\"><strong>Tramita&ccedil;&atilde;o<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Como foi&nbsp;<a href=\"http:\/\/www2.camara.leg.br\/camaranoticias\/noticias\/INDUSTRIA-E-COMERCIO\/484988-COMISSAO-REJEITA-PROJETO-QUE-SUBMETE-INCORPORACOES-IMOBILIARIAS-AO-REGIME-DE-AFETACAO.html\" target=\"_blank\" rel=\"noopener noreferrer\">rejeitado<\/a>&nbsp;pela Comiss&atilde;o de Desenvolvimento Econ&ocirc;mico, Ind&uacute;stria e Com&eacute;rcio, o projeto perdeu o car&aacute;ter conclusivo por ter tido pareceres divergentes nas comiss&otilde;es de m&eacute;rito.
