O debate integra a s&eacute;rie de encontros A Cidade &Eacute; Nossa.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Uma das principais mudan&ccedil;as trazidas pela lei &eacute; a permiss&atilde;o de instituir condom&iacute;nio urbano simples para qualquer im&oacute;vel que tenha nele constru&ccedil;&otilde;es de casas ou c&ocirc;modos e n&atilde;o apenas para aqueles que s&atilde;o objeto de Regulariza&ccedil;&atilde;o Fundi&aacute;ria Urbana.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; O condom&iacute;nio urbano simples &eacute; uma nova esp&eacute;cie de condom&iacute;nio a ser usado nas cidades. A matr&iacute;cula do im&oacute;vel faz a distin&ccedil;&atilde;o entre as partes do terreno ocupadas pelas edifica&ccedil;&otilde;es, as de uso exclusivo e as de passagem para vias p&uacute;blicas.<\/p>\n<p style=\"text-align: justify;\"><strong>Im&oacute;vel da Uni&atilde;o<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Outra novidade trazida pela lei &eacute; a permiss&atilde;o ao ocupante de um im&oacute;vel da Uni&atilde;o de propor a compra, por meio de regulamenta&ccedil;&atilde;o da Secretaria de Patrim&ocirc;nio da Uni&atilde;o (SPU). Nesse caso, o ocupante precisa estar regularmente inscrito e em dia com suas obriga&ccedil;&otilde;es junto &agrave; secretaria, comprovar o per&iacute;odo de ocupa&ccedil;&atilde;o, apresentar avalia&ccedil;&atilde;o do im&oacute;vel e das benfeitorias, fazer a proposta de pagamento e, para im&oacute;veis rurais, o georreferenciamento e o Cadastro Ambiental Rural (CAR) individualizado. A SPU pode n&atilde;o autorizar a compra, mas a proposta pode ser feita.<\/p>\n<p style=\"text-align: justify;\"><strong>Resolu&ccedil;&atilde;o extrajudicial<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Para o secret&aacute;rio de Gest&atilde;o do Territ&oacute;rio e Habita&ccedil;&atilde;o do Distrito Federal, Thiago de Andrade, no caso do DF, o mais importante da lei &eacute; permitir a resolu&ccedil;&atilde;o extrajudicial de conflitos e mais rapidez no registro em cart&oacute;rio, ap&oacute;s o processo de regulariza&ccedil;&atilde;o.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;E tem quest&otilde;es que mexem nas cidades, como loteamento fechado, condom&iacute;nio de lotes, que n&atilde;o t&ecirc;m necessariamente nada a ver com regulariza&ccedil;&atilde;o e que foram colocados na lei sem uma discuss&atilde;o maior com a sociedade&rdquo;, acrescenta Patryck. &ldquo;Ent&atilde;o essa promessa de que vai desburocratizar imediatamente e que, a partir dessa lei, fica muito mais f&aacute;cil registrar, &eacute; uma quest&atilde;o que merece ser discutida realmente&rdquo;.<\/p>\n<p style=\"text-align: justify;\"><strong>Irregularidades<\/strong><\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Mais de 50% dos im&oacute;veis urbanos no Brasil t&ecirc;m alguma irregularidade fundi&aacute;ria. Entre os avan&ccedil;os da nova lei, Patryck aponta o ato &uacute;nico de registro, que facilita o registro da regulariza&ccedil;&atilde;o fundi&aacute;ria. Ainda assim, segundo ele, n&atilde;o haveria necessidade de mudan&ccedil;a na legisla&ccedil;&atilde;o para adotar esse procedimento.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Para o deputado Izalci Lucas (PSDB-DF), as novas regras destravam os procedimentos da regulariza&ccedil;&atilde;o fundi&aacute;ria urbana e consolidam o que j&aacute; estava constru&iacute;do at&eacute; o fim de 2016. Ele cita como um dos poss&iacute;veis beneficiados o assentamento Incra-8, uma &aacute;rea rural de Brazl&acirc;ndia (DF).<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; &ldquo;Os caras est&atilde;o produzindo, vieram pra Bras&iacute;lia no in&iacute;cio do DF, em 1960. At&eacute; hoje esse pessoal produz morango, goiaba, arroz, feij&atilde;o, tudo, e os caras n&atilde;o t&ecirc;m escritura. As pessoas nem acreditam mais que essa lei agora vai resolver&rdquo;, analisa o parlamentar. &ldquo;Faz uma pesquisa que voc&ecirc; vai ver, com os moradores que est&atilde;o l&aacute; h&aacute; 40 anos, que eles n&atilde;o acreditam, depois de tantas promessas que foram feitas. Ent&atilde;o essa lei vai dar a eles essa possibilidade&rdquo;.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; A segunda edi&ccedil;&atilde;o do F&oacute;rum Interativo de Desenvolvimento Urbano foi realizada por sugest&atilde;o do presidente da comiss&atilde;o, deputado Givaldo Vieira (PT-ES), e realizado em parceria com o Conselho de Arquitetura e Urbanismo do Brasil.
