Desde 16 de maio, associa\u00e7\u00f5es de registradores de im\u00f3veis n\u00e3o podem mais fazer cobran\u00e7a adicional aos emolumentos dos cart\u00f3rios pelo uso do Sistema de Registro Eletr\u00f4nico de Im\u00f3veis (SREI) por parte de incorporadoras, imobili\u00e1rias, bancos, escrit\u00f3rios de advocacia e pessoas f\u00edsicas.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0O Registro de Im\u00f3veis do Brasil, que re\u00fane associa\u00e7\u00f5es estaduais dos registradores, avalia deixar de oferecer esses servi\u00e7os compartilhados caso a decis\u00e3o definitiva seja de que n\u00e3o pode haver cobran\u00e7a pelo uso dessa ferramenta. Hoje, termina o prazo do julgamento administrativo, em que conselheiros do CNJ votam se ratificam ou n\u00e3o a decis\u00e3o liminar. Se confirmada, a proibi\u00e7\u00e3o da cobran\u00e7a pelo uso do sistema eletr\u00f4nico compartilhado ter\u00e1 validade at\u00e9 o exame de m\u00e9rito. A liminar foi concedida pelo CNJ em resposta a uma solicita\u00e7\u00e3o feita em Minas Gerais.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cA plataforma \u00e9 uma conveni\u00eancia que possibilita que o registro seja feito mais rapidamente\u201d, afirma o presidente da Associa\u00e7\u00e3o Brasileira das Incorporadoras Imobili\u00e1rias (Abrainc), Luiz Antonio Fran\u00e7a. Na avalia\u00e7\u00e3o do representante setorial, a cobran\u00e7a pelo uso dos servi\u00e7os eletr\u00f4nicos compartilhados \u00e9 necess\u00e1ria, e haver\u00e1 um retrocesso se deixarem de ser oferecidos. Fran\u00e7a cita que, nos repasses, por exemplo, quanto menor o prazo para o registro da opera\u00e7\u00e3o, mais rapidamente o comprador pode se mudar para o im\u00f3vel, a incorporadora reduz sua d\u00edvida com o banco, e a institui\u00e7\u00e3o financeira recebe pelo financiamento.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Al\u00e9m da plataforma, quem precisa de servi\u00e7os relacionados ao registro de im\u00f3veis pode recorrer ao balc\u00e3o dos cart\u00f3rios e \u00e0s p\u00e1ginas de internet individuais dos cart\u00f3rios. Segundo o Registro de Im\u00f3veis do Brasil, os servi\u00e7os eletr\u00f4nicos compartilhados oferecidos pelas associa\u00e7\u00f5es possibilitam acesso di\u00e1rio \u00e0 matr\u00edcula dos im\u00f3veis em tempo real e obten\u00e7\u00e3o de certid\u00e3o digital em duas horas ante o prazo de 24 horas dos cart\u00f3rios. Pela plataforma, o registro de uma transmiss\u00e3o de propriedade leva at\u00e9 cinco dias \u00fateis, metade do tempo necess\u00e1rio se a opera\u00e7\u00e3o for solicitada em cart\u00f3rio. Em algumas situa\u00e7\u00f5es, ao fazer o pedido pelo sistema integrado, o usu\u00e1rio pode prescindir de viajar a outro estado.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Recentemente, a Trisul registrou, de forma totalmente digital, a incorpora\u00e7\u00e3o imobili\u00e1ria de um empreendimento que ser\u00e1 lan\u00e7ado na capital paulista. O gerente jur\u00eddico da companhia, Jos\u00e9 Carlos Mascarenhas Neves, diz acreditar que essa tenha sido a primeira opera\u00e7\u00e3o desse tipo no Estado de S\u00e3o Paulo. Na avalia\u00e7\u00e3o do executivo da incorporadora, a utiliza\u00e7\u00e3o das possibilidades oferecidas pelo sistema eletr\u00f4nico \u00e9 \u201csem volta\u201d.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0\u201cA agilidade dos processos permite economia de tempo e de dinheiro, al\u00e9m de mais efici\u00eancia\u201d, afirma o vice-presidente da C\u00e2mara Brasileira da Ind\u00fastria da Constru\u00e7\u00e3o (Celso Petrucci), acrescentando que os custos pela utiliza\u00e7\u00e3o do sistema est\u00e3o \u201cmuito bem assimilados\u201d e que a plataforma facilita a vida de empresas e consumidores finais. \u201cIsso estar sendo debatido agora me causa estranheza\u201d, diz Petrucci, referindo-se \u00e0 liminar.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Para o presidente da rede de imobili\u00e1rias Brasil Brokers, Claudio Hermolin, ser\u00e1 \u201cp\u00e9ssimo para o setor\u201d se os servi\u00e7os da plataforma deixarem de ser oferecidos. \u201cN\u00f3s brigamos para ter, cada vez mais, agilidade e transpar\u00eancia nas transa\u00e7\u00f5es imobili\u00e1rias, o que contribui para a seguran\u00e7a jur\u00eddica e para atrair investidores\u201d, diz Hermolin. O presidente da Brasil Brokers destaca que o sistema re\u00fane informa\u00e7\u00f5es de unidades imobili\u00e1rias, pr\u00e9dios inteiros e terrenos e que, sem acesso \u00e0 plataforma, investidores institucionais e pequenos investidores t\u00eam menos seguran\u00e7a na tomada da decis\u00e3o de compra.<\/p>\n<p style=\"text-align: justify;\">\u00a0 \u00a0 \u00a0Petrucci, da CBIC, questiona quem arcar\u00e1 com as despesas de manuten\u00e7\u00e3o dos servi\u00e7os compartilhados se n\u00e3o puder haver cobran\u00e7a por parte das centrais de registro. Segundo o presidente do Registro de Im\u00f3veis do Brasil, Flaviano Galhardo, as associa\u00e7\u00f5es deixar\u00e3o de ter recursos para custeio da plataforma se a n\u00e3o cobran\u00e7a pelos servi\u00e7os eletr\u00f4nicos compartilhados se estender por mais dois ou tr\u00eas meses. \u201cSe o servi\u00e7o for tirado do ar, haver\u00e1 um retrocesso de mais de 20 anos\u201d, diz Galhardo. \u201cO usu\u00e1rio perder\u00e1 a rapidez do documento eletr\u00f4nico padronizado\u201d, acrescenta. De acordo com o presidente do Registro de Im\u00f3veis do Brasil, o envio de documentos para registro (e-protocolo) e o pedido de certid\u00f5es n\u00e3o eram cobrados mesmo antes da liminar.<\/p>\n<p
