dados registrais, das pessoas em estado de vulnerabilidade socioecon\u00f4mica, pelo Cart\u00f3rios de Registro Civil de Pessoas Naturais, diretamente ou por interm\u00e9dio da Central de Informa\u00e7\u00f5es de Registro Civil de Pessoas Naturais- CRC, aos Institutos de Identifica\u00e7\u00e3o dos Estados e do Distrito Federal, para fins exclusivos de emiss\u00e3o de registro geral de identidade.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>O CORREGEDOR NACIONAL DE JUSTI\u00c7A<\/strong>, usando de suas atribui\u00e7\u00f5es constitucionais, legais e regimentais e<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0o poder de fiscaliza\u00e7\u00e3o e de normatiza\u00e7\u00e3o do Poder Judici\u00e1rio dos atos praticados por seus \u00f3rg\u00e3os (art. 103-B, \u00a7 4\u00ba, I, II e III, da Constitui\u00e7\u00e3o Federal de 1988);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0a compet\u00eancia do Poder Judici\u00e1rio de fiscalizar os servi\u00e7os notariais e de registro (arts. 103-B, \u00a7 4\u00ba, I e III, e 236, \u00a7 1\u00ba, da Constitui\u00e7\u00e3o Federal);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0a compet\u00eancia do Corregedor Nacional de Justi\u00e7a de expedir provimentos e outros atos normativos destinados ao aperfei\u00e7oamento das atividades dos servi\u00e7os notariais e de registro (art. 8\u00ba, X, do Regimento Interno do Conselho Nacional de Justi\u00e7a);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0a obriga\u00e7\u00e3o dos not\u00e1rios e registradores de cumprir as normas t\u00e9cnicas estabelecidas pelo Poder Judici\u00e1rio (arts. 37 e 38 da Lei n. 8.935, de 18 de novembro de 1994);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0que a cidadania e dignidade da pessoa humana constituem fundamentos constitucionais do Estado Democr\u00e1tico de Direito (art. 1\u00ba da Constitui\u00e7\u00e3o de Federal);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0que s\u00e3o objetivos fundamentais da Rep\u00fablica Federativa do Brasil a constru\u00e7\u00e3o de uma sociedade livre, justa e solid\u00e1ria, a garantia do desenvolvimento nacional, a erradica\u00e7\u00e3o da pobreza e da marginaliza\u00e7\u00e3o, a redu\u00e7\u00e3o de desigualdades sociais e regionais, a promo\u00e7\u00e3o do bem de todos, sem preconceitos de origem, ra\u00e7a, sexo, cor, idade e quaisquer outras formas de discrimina\u00e7\u00e3o (art. 3\u00ba da Constitui\u00e7\u00e3o de Federal);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO\u00a0<\/strong>necessidade de garantir \u00e0s pessoas em situa\u00e7\u00e3o de maior vulnerabilidade acesso \u00e0 obten\u00e7\u00e3o de documentos civis, nos termos da al\u00ednea \u201cb\u201d inciso XXXIV do artigo 5\u00ba da Constitui\u00e7\u00e3o Federal;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO\u00a0<\/strong>que a Agenda 2030 das Na\u00e7\u00f5es Unidas \u00e9 um plano de a\u00e7\u00e3o com metas e indicadores globais, adotado por 193 Pa\u00edses, inclusive o Estado brasileiro, e possui por escopo a efetiva\u00e7\u00e3o dos direitos humanos e a promo\u00e7\u00e3o do desenvolvimento sustent\u00e1vel em suas dimens\u00f5es social, econ\u00f4mica, ambiental e institucional;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0que a Agenda 2030 est\u00e1 alinhada aos princ\u00edpios constitucionais e ao Plano Plurianual Cidad\u00e3o-PPA Cidad\u00e3o;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO\u00a0<\/strong>a ades\u00e3o da Corregedoria Nacional de Justi\u00e7a \u00e0\u00a0Agenda 2030 das Na\u00e7\u00f5es Unidas\u00a0(Provimento n\u00ba 85\/2019), que disp\u00f5e no item 16.9 como Objetivo de Desenvolvimento Sustent\u00e1vel que\u00a0<em>\u201cat\u00e9 2030, fornecer identidade legal para todos, incluindo o registro de nascimento.\u201d<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0a incumb\u00eancia do Conselho Nacional de Justi\u00e7a de consolidar uma pol\u00edtica p\u00fablica permanente de desburocratiza\u00e7\u00e3o do servi\u00e7o p\u00fablico prestado ao cidad\u00e3o brasileiro (Lei n\u00ba 13.726\/2018);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0o compromisso nacional de amplia\u00e7\u00e3o do acesso do cidad\u00e3o brasileiro \u00e0 documenta\u00e7\u00e3o civil b\u00e1sica, mediante colabora\u00e7\u00e3o e articula\u00e7\u00e3o dos entes p\u00fablicos (art. 1\u00ba do Decreto n. 6.289, de 6 de dezembro de 2007);<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0a necessidade de acesso a dados biogr\u00e1ficos eletr\u00f4nicos para a obten\u00e7\u00e3o e confirma\u00e7\u00e3o de cadastros pelos\u00a0\u00f3rg\u00e3os p\u00fablicos e privados visando ao exerc\u00edcio de direitos fundamentais;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0que as pessoas em situa\u00e7\u00e3o de vulnerabilidade social n\u00e3o t\u00eam condi\u00e7\u00f5es socioecon\u00f4micas de obter os dados registrais para o exerc\u00edcio de direitos fundamentais;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0que a aus\u00eancia dos dados registrais tem impedido o fornecimento dos demais documentos civis das pessoas em situa\u00e7\u00e3o de vulnerabilidade, atingindo o exerc\u00edcio da cidadania, o que, por quest\u00e3o humanit\u00e1ria e escopo do Estado Democr\u00e1tico de Direito, exige esfor\u00e7os das institui\u00e7\u00f5es para sua supera\u00e7\u00e3o;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CONSIDERANDO<\/strong>\u00a0que a tecnologia permite a organiza\u00e7\u00e3o nacional de remessa digital dos dados registrais de forma organizada e uniformizada;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>RESOLVE<\/strong>:<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Art. 1\u00ba<\/strong>\u00a0Os Cart\u00f3rios de Registro Civil de Pessoas Naturais, diretamente ou por interm\u00e9dio da Central de Informa\u00e7\u00f5es de Registro Civil de Pessoas Naturais- CRC, enviar\u00e3o aos Institutos de Identifica\u00e7\u00e3o dos Estados e do Distrito Federal, gratuitamente, os dados registrais das pessoas em estado de vulnerabilidade socioecon\u00f4mica, para fins exclusivos de emiss\u00e3o de registro geral de identidade.<\/p>\n<p>&nbsp;<\/p>\n<p>Par\u00e1grafo \u00fanico. Os cart\u00f3rios de registro civil ou a Central de Informa\u00e7\u00f5es de Registro Civil de Pessoas Naturais- CRC dever\u00e3o enviar, eletronicamente, os dados registrais das pessoas em estado de vulnerabilidade socioecon\u00f4mica, em at\u00e9 48 (quarenta e oito) horas, a contar do recebimento da solicita\u00e7\u00e3o Institutos de Identifica\u00e7\u00e3o dos Estados e do Distrito Federal.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Art. 2\u00ba\u00a0<\/strong>Considera-se em estado de vulnerabilidade socioecon\u00f4mica:<\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li>popula\u00e7\u00e3o em situa\u00e7\u00e3o de rua, definida no Decreto n. 7.053\/2009;<\/li>\n<li>povos e comunidades tradicionais, hipossuficientes, definidos no Decreto n. 6.040\/2007;<\/li>\n<li>pessoa beneficiada por programas sociais do governo federal;<\/li>\n<li>pessoa com defici\u00eancia ou idosa incapaz de prover sua manuten\u00e7\u00e3o, cuja renda familiar, per capta, seja igual ou inferior a \u00bc do sal\u00e1rio m\u00ednimo;<\/li>\n<li>migrantes, imigrantes e refugiados sem qualquer identidade civil nacional.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>\u00a7 1\u00b0 A comprova\u00e7\u00e3o de quaisquer das hip\u00f3teses previstas neste artigo ser\u00e1 efetuada pelos \u00f3rg\u00e3os p\u00fablicos, inclusive de assist\u00eancia social dos Estados e Munic\u00edpios, no momento em que formularem a solicita\u00e7\u00e3o aos institutos de identifica\u00e7\u00e3o.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00a7 2\u00b0 Incorrer\u00e1 em crime, o agente p\u00fablico que, falsamente, atestar a exist\u00eancia de estado de vulnerabilidade socioecon\u00f4mica inexistente.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Art. 3\u00ba<\/strong>\u00a0Este provimento entra em vigor na data de sua
