O&nbsp;artigo 1.071&nbsp;do novo C&oacute;digo de Processo Civil&nbsp;passou a regular procedimento extrajudicial, deixando de exigir&nbsp;a via judicial&nbsp;para a busca da regulariza&ccedil;&atilde;o da propriedade de im&oacute;vel, acrescentando o artigo 216-A&nbsp;&agrave; Lei de Registros P&uacute;blicos (6015\/1973).<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Com essa nova modalidade, o legislador brasileiro buscou a desburocratiza&ccedil;&atilde;o da usucapi&atilde;o, o que, anteriormente, somente era poss&iacute;vel por meio de um processo judicial.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; &Eacute; evidente que, com a utiliza&ccedil;&atilde;o da via extrajudicial para obten&ccedil;&atilde;o da usucapi&atilde;o,&nbsp;n&atilde;o haver&aacute; necessidade de esse processo passar pelas m&atilde;os de um juiz ou promotor p&uacute;blico para que se possa ver efetivada a regulariza&ccedil;&atilde;o da propriedade do im&oacute;vel.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Entretanto, as regras impostas pela lei e os requisitos normativos ter&atilde;o que ser atendidos, sob pena de n&atilde;o haver sua consuma&ccedil;&atilde;o.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Com essa nova regra procedimental, a responsabilidade e autoridade passa para as m&atilde;os do oficial de Registro de Im&oacute;veis, o chamado Cart&oacute;rio de Registro de Im&oacute;veis.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; O instituto da usucapi&atilde;o extrajudicial somente poder&aacute;&nbsp;ser utilizado quando n&atilde;o houver qualquer diverg&ecirc;ncia na pretens&atilde;o do requerente, ou seja, que a posse seja mansa e pac&iacute;fica, n&atilde;o havendo nenhuma restri&ccedil;&atilde;o ou obje&ccedil;&atilde;o dos confrontantes do im&oacute;vel que ser&aacute; seu objeto.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Para isso, o requerente ter&aacute; que atender alguns dos requisitos impostos n&atilde;o s&oacute; pela lei como tamb&eacute;m pelas pr&oacute;prias regras determinadas pela Corregedoria do respectivo tribunal e, ainda, por provimento emitido pelo pr&oacute;prio Conselho Nacional de Justi&ccedil;a<a href=\"https:\/\/www.conjur.com.br\/2018-fev-20\/eli-alves-silva-novas-regras-usucapiao-extrajudicial#_ftn1\" name=\"_ftnref1\" title=\"\">[1]<\/a>.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; O artigo 2&ordm;&nbsp;do referido provimento &eacute; expresso em determinar que, sem preju&iacute;zo da via jurisdicional (quando &eacute; apresentado diretamente ao juiz de Direito), &eacute; admitido o pedido de reconhecimento extrajudicial da usucapi&atilde;o formulado diretamente pelo requerente, representado por advogado ou defensor p&uacute;blico, nos termos do disposto no artigo&nbsp;216-A da LRP (Lei de Registros P&uacute;blicos), que ser&aacute; processado diretamente no of&iacute;cio de registro de im&oacute;veis da circunscri&ccedil;&atilde;o em que estiver localizado o im&oacute;vel usucapiendo ou a maior parte dele.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Ainda, para instruir o requerimento, atendendo determina&ccedil;&atilde;o legal estampada no artigo 216-A&nbsp;da Lei 6.015\/1973, com altera&ccedil;&otilde;es recebidas atrav&eacute;s da Lei 13.105, de 2015, dever&aacute; ser instru&iacute;do com a ata notarial lavrada pelo tabeli&atilde;o, atestando o tempo de posse do requerente e de seus antecessores, conforme o caso e suas circunst&acirc;ncias; com planta e memorial descritivo assinado por profissional legalmente habilitado, com prova de anota&ccedil;&atilde;o de responsabilidade t&eacute;cnica no respectivo conselho de fiscaliza&ccedil;&atilde;o profissional, assim como pelos titulares de direitos registrados ou averbados na matr&iacute;cula do im&oacute;vel usucapiendo ou na matr&iacute;cula dos im&oacute;veis conflitantes; com as certid&otilde;es negativas dos distribuidores da comarca da situa&ccedil;&atilde;o do im&oacute;vel e do domic&iacute;lio do requerente.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Al&eacute;m disso, junto com o requerimento endere&ccedil;ado ao oficial do Cart&oacute;rio de Registro de Im&oacute;veis, tamb&eacute;m dever&aacute; acompanhar o justo t&iacute;tulo ou quaisquer outros documentos que demonstrem a origem, a continuidade, a natureza e o tempo de posse, tais como o pagamento de impostos e das taxas que incidirem sobre o im&oacute;vel.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Estando atendidos todos os requisitos impostos pela pr&oacute;pria lei, o oficial do Cart&oacute;rio de Registro de Im&oacute;veis determinar&aacute; ci&ecirc;ncia &agrave; Uni&atilde;o, ao estado, ao Distrito Federal (quando for o caso) e ao munic&iacute;pio, pessoalmente, por interm&eacute;dio do oficial de registro de t&iacute;tulos e documentos, ou pelo correio com aviso de recebimento, para que se manifestem, em 15 dias, sobre o pedido. Da mesma forma ser&atilde;o cientificados os confrontantes que no mesmo prazo t&ecirc;m que se manifestar, sob pena de, em n&atilde;o o fazendo, ser considerado como concordantes.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Transcorridos os prazos, sem pend&ecirc;ncias de dilig&ecirc;ncias na forma par&aacute;grafo 5&ordm;, do artigo 216-A, e achando-se em ordem a documenta&ccedil;&atilde;o, o oficial de Registro de Im&oacute;veis registrar&aacute; a aquisi&ccedil;&atilde;o do im&oacute;vel com as descri&ccedil;&otilde;es apresentadas, sendo permitida a abertura de matr&iacute;cula, se for o caso.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Havendo alguma pend&ecirc;ncia em termos de documenta&ccedil;&atilde;o e atendimento dos requisitos exigidos, o oficial do Registro de Im&oacute;veis poder&aacute; rejeitar o pedido, cabendo &agrave; parte, n&atilde;o concordando com tal decis&atilde;o, buscar a via do Poder Judici&aacute;rio.<\/p>\n<p style=\"text-align: justify;\">&nbsp;&nbsp;&nbsp;&nbsp; Essas novas regras regulando a possibilidade da usucapi&atilde;o extrajudicial traz&nbsp;a possibilidade de maior agiliza&ccedil;&atilde;o e desburocratiza&ccedil;&atilde;o, bem como a condi&ccedil;&atilde;o para que o detentor de posse mansa e pac&iacute;fica de um im&oacute;vel possa regularizar a sua propriedade e, consequentemente, fazer uso dela de forma tranquila e segura, inclusive&nbsp;podendo constar no seu rol de bens reais.<\/p>\n<div>\n<hr \/>\n<div id=\"ftn1\">\n<p style=\"text-align: justify;\"><a name=\"_ftn1\">[1]<\/a> Provimento 65, de 14\/12\/2017, que estabelece diretrizes para o procedimento da usucapi&atilde;o extrajudicial nos servi&ccedil;os notariais e de registro de im&oacute;veis.<\/p>\n<p style=\"text-align: justify;\"><em><a href=\"mailto:%65%6c%69%40%65%6c%69%61%6c%76%65%73%64%61%73%69%6c%76%61%61%64%76%6f%67%61%64%6f%73%2e%63%6f%6d%2e%62%72\"
